Copyright

Copyright is one of the most important intellectual property rights. By definition, it is a legal term used to describe the rights that creators have over their works, be it an idea, artistic work, cinematography, colour schemes, calligraphy, audio visuals. This includes books, music, computer programs, databases, advertisements, blueprints, and business models. A copyright grants you complete authorization over their intellectual assets under the laws of Pakistan and applicable international laws.

What is Copyright Registration?

Copyright registration is like giving your creative work a legal ID card. It’s a simple way to officially claim ownership and protection for your original creations, whether it’s art, music, or other forms of expression. Think of it as your work’s passport to security and recognition.

Who can be the owner of the copyright?

  • Individuals: If you create something, it’s yours
  • Employees: If you create as part of your job, your employer may own it.
  • Team Efforts: If you work together, everyone can own a piece.
  • Companies: Businesses can own what employees create.
  • Hidden Identity: Even if you’re unknown, your creation is still protected.

Our procedure of copyright registration in Pakistan

Anyone interested in copyright for their work can apply by filling out a form and paying the required fee. This application, along with the fee, is submitted to the Registrar to record the details of the work in the Register of Copyrights. Each work needs a separate application. To register copyright, you need to submit the following documents to the Registrar of Copyrights:

1 – FILING THE APPLICATION:

Submit your registration application using Form-II in triplicate. The person applying should also send a copy to anyone else affected by the copyright. Include a Statement of Particulars, submitted in triplicate. For certain works, like Literary, Dramatic, Musical, and Artistic creations, provide a Statement of Further Particulars in triplicate. Finally, send two copies of the original work for copyrighting.

2 – EXAMINATION:

When you hire someone to create a copyrighted work, they need to swear that they don’t have any rights to it. The registration fee is paid through a Demand Draft made out to DG IPO. For artistic works, the applicant puts a notice in the newspaper and submits two copies to the copyright recorder. The ad should follow the prescribed format outlined in the Copyright Rules.

3 – REGISTRATION:

Upon receiving your application, the Registrar will record the details of your work in the Copyrights Register. You’ll be issued a registration certificate unless there’s a specific reason not to, which will be explained in writing. This certificate serves as strong evidence that copyright exists for your work and the person listed is the rightful owner.
